And don't be fooled by those incorrectly informed 2nd Amendment proponents who say on the one hand that the Constitution forbids the federal government from restricting citizens' righs to bear arms but on the other hand it does allow the state to impose the restrictions. It's not true.

The Constitution makes clear that there are three entities at play, the federal government, the state government and the people.

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

Clearly the right belongs to the people, not the state which includes the militia. The militia is under the authority of the state governor or of the President when called to national service (Article II, Sec. 2). The militia is not "the people". There's not a word anywhere in the 2nd Amendment one way or the other regarding the federal government's authority to infringe the right. And so, we have to refer to the 10th Amendment.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

Infringing the people's right to bear arms is not a delegated power to the federal government thus it has no authority. It is prohibited to the states by the 2nd Amendment. It is a right of the people now supported by two Amendments.

Next check the 9th Amendment (which is rarely done - few people are even aware of it).

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

This was added because during the ratification process between 1787-1789 the argument was proposed that because the Constitution limits the federal government to the specific enumerated powers that someone in government would argue that the same applies to the people - that powers not specifically enumerated to the people were not their rights. The 9th Amendment makes it clear that the people's rights are not so limited and that the government cannot so interpret the situation. The peoples' rights are broad and left mostly undefined in the Constitution. The government's rights and authority is narrow and specific. This is a third Amendment supporting the right of the people to bear arms without infringement.

Yet California wants to infringe on the right to bear arms by narrowly defining the term so as not to include ammunition within the meaning of "(fire) arms", i.e. you can have your gun but we won't let you buy ammunition for it.
 
In Ausi-land, you still need to register by serial number each and every gun. Personally, I'd think you should stay and fight it out RMT.

As for the 2nd A, "A well regulated militia", in 1776, had a slightly different meaning back then. Kind of like the word "gay", which once upon a time meant "happy". Back in 1776, "well regulated" meant "well equipped" and "militia" referred to armed citizens or commoners. This information from from a lawyer who studied constitutional law and wrote a paper about it. In his research, he read many many written papers of our founding fathers and from those he could discern that "regulated" referred to "equipped" and "militia" referred to civilians.

Any idea why the Dept of Education and IRS need short barreled shotguns with collapsible stocks and tritium sights? Or why the Dept. of Agriculture needs thermal vision sniper scopes? Even IF firearms were never invented and didn;t exist,. you would still all kinds of crime in the USA. Crime would just be messier with blunt objects and it would be the strong over the weak (kind of like cavemen times).

Good point Timelord, However, For those who are like me and don't have the time to become adept in the practices and traditions of combative martial arts, or the available resources to manufacture or assemble such an arsenal of I.E.D'S, and other explosives, Firearms to are just a lot simpler and plenty effective for those who are trained to use them safely and responsibly.
 
Excellent points Timecrime. There are numerous instances of criminal's stepping into trap's set-up by people who have been contiunously burglarized, then turning around to sue those people for the injuries caused by the trap.

Most gun "accidents" are caused by negligence and poor judgment.

Really, it comes down to training, education and experience.

No matter the method used, when it comes to personal defense, without the appropriate training, education, and practice ; The attempted use of force against an attacker is potentially just as lethal to the user.

While I am a solid opponent to anything that would diminish our 2nd Amendment rights as US citizens, I am a bigger opponent to baseless fearmongering by only telling partial facts. The person who wrote this email either is woefully undereducated on our Constitution and its provisions for how the US ratifies international treaties, or they know full well these aspects of federal law and are simply omitting them because it serves his/her scaremongering objectives. Not unlike a lot of the "time travelers" we see here who love to tell us how terrible our future is...

No, actually, Obama cannot. One must read what the Constitution says about the President's power to make and ratify treaties. From Article II, Section 2, Clause 2:

Which is further expanded upon here:

The last sentence is the key piece of information that this scaremonger left out...

Depends on the interpretation of "US Government". If he means only the executive branch, he is wrong. If he means, specifically, ratified by 2/3 of the Senate, then this is correct. Interesting, though, how he purposefully never spelled-out what he meant by this... so uneducated people might presume the worst, and take his "fear bait".

Apples and oranges. First he is talking about international treaties, and now he wishes to compare it to domestic legislation (Health Care). As we just saw in the Health Care vote, the Health Care Bill did NOT require 2/3 of the Senate to send it to the President's desk to sign it into law. If it did require 2/3 of the Senate, it never would have made it to the President's desk!

This week the departments of defence wrote a letter to the owner of georgia arms telling them that from now on the d.o.d. will be destroying all of the spent brass, it will no longer be available to ammo makers unless they want to buy it in scrap shredded condition, Which ammo makers have no use for. The shredded brass is now going to be sold by the d.o.d. to china as scrap metal, after the dod pays for it to be shredded, the dod is selling the scrap metal to china for less than the ammo makers have been paying, plus, the dod has to pay for the shredding along with product accountability and and any other bureaucratic attachments that are involed. The brass has no value to the ammo maker if it is shredded or melted, The owner of georgia arms says he has 2 or 3 months of inventory left, so by summer he is out, along with his 60 plus employees,

this really helps the economy right?.....Sell to china and not to a proven u.s. buissness... Hidden agenda here?..If the industry has to buy new manufactured brass then the cost of ammo will double or triple, plus obama is pushing to add a 500% tax to each shell. Obama, Again, Going after the fire arms industry.

Yes, and it's a complete mockery of justice. Anyone who deliberately breaks into a house and is trying to creep around in stealth ( without announcing themselves ) deserves whatever comes their way. I have absolutely NO sympathy if they get their brains blown out. Nobody is forcing them to be there......they are there of their own choice, and should accept the consequences.

If they get a new window to the world punched in their forehead I doubt that they would have any choice in the matter of accepting or rejecting the consequences.

I was responding to that paragraph. If the intruder is dead s/he is unlikely to have any say-so in accepting or rejecting the consequences. DOA is DOA.
